The last time Congress wrote major technology law, TikTok didn't exist. The iPhone was four years old. "Machine learning" was a graduate seminar topic. Now AI systems write legal briefs, screen job applications, diagnose medical conditions, generate deepfakes, and operate semi-autonomously in military systems — all with almost no statutory framework governing any of it.

This is the core tension: AI is moving faster than democratic institutions can track. The U.S. has no comprehensive federal AI law. Instead, it has a patchwork of executive orders, agency guidance documents, and voluntary industry commitments that companies can — and do — ignore. Meanwhile, the EU's AI Act took effect in 2024, China has its own AI governance regime, and American AI companies now face a three-way choice: comply with the most stringent foreign standard, lobby against U.S. regulation to maintain the status quo, or support a U.S. framework they help shape. That third option — a federal framework that preserves American AI leadership while setting meaningful guardrails — is what the AI regulation debate is actually about.
